Training and Events Terms and Conditions

Use Description

Any product, content or materials viewed through our service, is solely for your personal and non-commercial use.  

Member Account, Password and Security

You may never use another’s account, and you may not provide another person with the username and password to access your account. You should maintain control over all of the devices that are used to access the product. If you fail to maintain control of a device, other users may access the product through your account and may be able to access certain of your account information.

You are fully responsible for any and all activities that occur under your password or account, and it is your responsibility to ensure that your password remains confidential and secure. You agree to (a) immediately notify COSRT of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Service. COSRT will not be liable for any loss or damage arising from your failure to comply with this Section.

Service Content, Software, Intellectual Property and Trademarks

You acknowledge and agree that the service may contain content or features (“Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. In connection with your use of the service you will not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods. 

At all times, COSRT remains the owner of the intellectual property in the content unless otherwise stated. No product or any part thereof may be reproduced, modified, framed, scraped, rented, leased, loaned, sold, distributed or have any derivative works created from it without the prior written permission of COSRT.

In consideration of receipt by us of the product fee, COSRT grants to you a non-exclusive, non-transferable licence to use the product and associated materials and for the sole purpose of completing the product purchased.  The licence granted is to use and access the content on one computer only. COSRT may revoke your license at any time in its sole discretion. Upon such revocation, you must promptly destroy all content downloaded or otherwise obtained through the service, as well as copies of such materials, whether made in accordance with these Terms of Service or otherwise.

You may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, disseminate or distribute in any way any of the product or associated materials/content. 

Use of the product or associated content/materials not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of either COSRT’s copyright or COSRT’s other intellectual property rights, and/or the copyright or other intellectual property rights of COSRT’s licensors.

The COSRT name and logos are trademarks and service marks of COSRT (collectively the “COSRT Marks”). Other COSRT, product, and service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to COSRT. Nothing in this Terms of Service or the Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of COSRT’s Marks without our prior written permission in each instance. All goodwill generated from the use of COSRT Marks will inure to our exclusive benefit.

Our liability to you

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we confirmed your order.

We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity in connection with or in any way arising out of your order with us.

We do not exclude or limit in any way our liability for: i. death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or ii. fraud or fraudulent misrepresentation.

Our maximum aggregate liability to you for any claims that you may have against us for direct loss in contract, tort or otherwise arising out of or in connection with these Terms, the Course and any technical support shall be limited to the amount of the Course fee which has been paid, or is payable, by you or on your behalf.

We expect you to take reasonable care to verify that the product in question will meet your needs. We do not make any commitment to you that you will obtain any particular result from your use of the content or that you will obtain any particular qualification on completion of the product.

In no event will COSRT be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from attending events or accessing any form of training unless it is directly due to negligence on its part.

In no event will COSRT be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from using the material or information gained at COSRT events or through any COSRT training.

COSRT may not be held responsible for any infringements as a result of plagiarism, libel, slander or any misuse of any material by any speaker, presenter, trainer or any party providing event or training services for COSRT.

COSRT shall not be responsible or liable for any loss or damages of any nature whether direct or indirect including any loss of profits or any consequential damages suffered or incurred by the event attendees for whatever reason.

    Price changes

    Our prices may change at any time, but price changes will not affect any order that we have confirmed with you by email. All prices include VAT at the point of sale.

    Third Party Material

    Under no circumstances will COSRT be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

    Functionality

    We do not make any representation, guarantee or commitment to you that the product material will be error free.

    We do not make any commitment that the product will be compatible with or operate with your software or hardware.

    You may incur charges to your internet service provider while you are accessing and/or downloading the product or associated materials. Charges may also be payable to third parties for use of the software necessary to access and/or download the product materials. You are responsible to pay these charges.

    It is your responsibility to check that the computer you plan to use to access the product is compatible with the minimum specification requirement for your Course. You accept that we cannot be held responsible for any technical problems you encounter following the purchase of an online product.

    COSRT endeavours to ensure that the material provided is true and accurate at the time of initial upload or provision by COSRT but will not be held accountable for any content that is alleged to be inaccurate or in any way inappropriate.

    COSRT products, content and material may be changed or updated without notice. 

    You agree to use COSRT products as tools to improve your professional knowledge and understanding and will make no reliance on their content. 

    Products and associated materials may include links to external websites. These links are provided for your convenience to provide further information. They do not signify COSRT’s endorsement of the website(s). We have no responsibility for the content of the linked website(s).

    Termination

    You agree that COSRT, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of our services and remove and discard any content, for any reason, including, without limitation, for lack of use or if COSRT believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Service. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of service, may be referred to appropriate law enforcement authorities. COSRT may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms of Service may be effected without prior notice, and acknowledge and agree that COSRT may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that COSRT will not be liable to you or any third party for any termination of your access to the Service.

    Our cancellation rights

    We reserve the right to withdraw at any time any professional development activities advertised for sale by us, including for reasons beyond our control.

    For the purposes of this clause, circumstances beyond our control means any act or event beyond our reasonable control, including without limitation: cancellation of speakers or workshop providers for whatever reason, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks. We will notify you of such a cancellation as soon as reasonably possible.

    If we have to cancel an event for reasons beyond our control we may, at our discretion, offer to transfer you to a different event.

    Your cancellation rights

    In compliance with the distance selling cooling period, if you cancel within 7 working days of submitting an order and prior to accessing any product, you will receive a full refund of any monies paid in advance. We will refund you via the method you used to pay.  If you have accessed a product, its content or materials then you will not be liable for any refund.

    Where orders include bookings on live events with multiple available delivery dates, you may swap dates once, up to two weeks before the events. Swapping dates less than two weeks before the event, or making more than one swap is at the COSRT’s discretion, should be requested by email to info@cosrt.org.uk.

    If you cancel more than 14 days before a live event with a fixed date, you will be eligible to a full refund. If you cancel within 14 days of the event, you will not be eligible for a refund.

    Except as set out in these Terms, no cancellations and/or deferrals will be permitted for a product.

    Copyright Complaints

    COSRT respects the intellectual property of others. If you believe in good faith that any materials on the Sites infringe upon your copyrights, please send the following information to info@cosrt.org.uk:

    • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
    • Your address, telephone number, and email address;
    • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
    • a statement by you that the information in your notification is accurate, and that you are the copyright owner or are authorised to act on the copyright owner’s behalf;
    • A physical or electronic signature of the copyright owner or the person authorised to act on behalf of the owner of the copyright interest.
