Having clinical notes subpoenaed or a Service User make a Subject Access Request is often a very stressful experience. Many Psychosexual and Relationship Therapists may feel intimidated by the request and most are unsure what they can or cannot release to the third party. Additionally, there are often queries from Members as to what information should be recorded in the notes. Some of the questions to be addressed in this training include:
- Is it acceptable to keep limited notes or no notes?
- Should process notes be kept separately?
- If it is a couple, who has ownership of the notes, can one party request the notes without the others permission?
These are just some questions that are frequently asked.

About the Trainer
Benjamin James is a solicitor in London with McCarthy Denning. Having trained as a commercial solicitor he has spent most of the last twenty years advising charities. He has a special interest in intellection property, privacy, research and ethics. He is chairperson of Adoption Focus and Dartmoor Zoological Society, is a trustee of a number of other charities and is a former trustee of COSRT.
Whilst providing general commercial and governance advice to a wide range of charities, he also chairs the animal ethics board for Dartmoor Zoo and has undertaken complaints investigation and chaired complaints and fitness to practice meetings and hearings. Having spent 10 years advising on investigations, complaints and practice at a leading relationship counselling charity he has a particular knowledge of the issues affecting counsellors and psychosexual therapists. He has also lectured on the legal issues of surrounding sex therapy and ethics.
